This question is valid in any Real Estate transaction. You NEED to be  represented by a trained, experienced, and knowledgeable professional, whose only focus is to protect your interests..

In the United States there are, and continue to be, required disclosure laws in all Real Estate proceedings.  The Listing Agent’s fiduciary responsibility is to his/her seller in any transaction.   Were that agent to represent both parties, they could NOT really have your best interest at heart.  Remember that the Seller pays the commission!

"Dual Agency" (representing both parties) is tricky. "Dual Agency" in Mexico is dangerous to say the least.  The laws of confidentiality simply do not exist here as they do in the U.S.A. and in Canada as well.  

For example: 
We have often heard the following:  "The list price is $xxxxx, but they will take at least $xxxxx less!

Or, inversely:  "The Buyer is offering you $xxxxxxx, but I know they will pay much more".  Information is not held as confidential, information is passed without regard.

It is the mandate, responsibility, job, and function of any Buyer’s Real Estate Agent,  to perform “due-diligence”, and to protect you in any Real Estate Transaction.  This translates to finding out everything possible about the property, (including comparables where available), making sure the Trust, Title, and Deed are in place,  being sure the Seller is really authorized to sell, and then walking you through every step of the myriad details associated with a Mexican Real Estate purchase. 

It is not hard, it is not scary, when you know the person working with you is honorable and knows what they  are doing.

This is the professional you want in your corner during any Real Estate transaction,  but especially if you are considering a property or business purchase in a country not of your residence.

We are primarily “Buyer’s Agents”.  We work in your best interest in the transactions of Real Estate.  Period!!  We do not just send you to the bank for your Trust, or to the Notario for your paperwork, we are there with you the entire way from start to successful finish.

Few Real Estate sales people in Mexico have any formal training in Real Estate Law, Protocols or Ethics.

We are legal. We are registered with the Mexican Hacienda (IRS) and we pay our taxes. And most importantly, we have a clear understanding of the legalities involved in Buying or Selling property in Mexico.
