In the United States there has been and continues to be required disclosure in all proceedings. The listing agent’s fiduciary responsibility is to his/her seller in any deal, and were that agent to be a “dual agent” they could and cannot really have your best interest at heart. They may divulge some information, but they cannot, and should not divulge the intimate details of the seller’s position --- legally.
Where as; it is the job, responsibility and function of your “Buyer’s agent” to do “due-diligence”, which translates to finding out everything they possibly can about the property you are about to purchase.
